Terms and Conditions of Sale & Use

    These General Terms and Conditions of Sale and Use (hereinafter "T&C") govern the contractual relationship between:

    The Provider:

    And

    The Client / User:

    Any natural or legal person, business or individual, creating an account or subscribing to the editorial AI SaaS services offered by MyDataNest.

    The Provider and the Client are hereinafter collectively referred to as the "Parties".

    Article 1 - Purpose of Service

    These T&Cs define the conditions of access, subscription, and usage of the MyDataNest online platform (hereinafter the "Service"). MyDataNest is a Software as a Service (SaaS) solution offering AI agents dedicated to editorial strategy, copywriting, visual creation, and multi-channel publishing.

    Article 2 - Acceptance of Terms

    Registering on the platform, using the Service, or subscribing to a paid plan constitutes unreserved acceptance of these T&Cs. The Client confirms having read them prior to any subscription or use.

    Article 3 - Access & Subscription Terms

    The Service is accessible remotely via web browser. Access requires an active subscription plan (monthly or annual) or a trial period granted by the Provider. Each plan includes quotas of AI agent credits and workspace features detailed on the Pricing page.

    Article 4 - Account Registration & Security

    The Client agrees to provide accurate information and maintain the confidentiality of login credentials. All activity performed under the Client's account is deemed executed by the Client.

    Article 5 - Pricing & Payment Terms

    Subscription fees are listed on the Pricing page in Euros (€) or USD ($). Payments are processed securely via our PCI-DSS certified provider (Stripe). Subscriptions renew automatically at the end of each billing cycle unless cancelled. In case of payment failure, access to the Service is immediately suspended.

    Article 6 - Intellectual Property & Data Privacy

    The Client remains the sole owner of all brand data, uploaded files, and AI-generated content. The Provider guarantees strict data confidentiality and does NOT train third-party AI models on customer data.

    Article 7 - Cancellation

    The Client may cancel their subscription at any time via the account settings or Stripe billing portal. Cancellation will take effect at the end of the current billing cycle without prorated refund.

    Article 8 - Obligations of the Client

    The Client agrees to use the Service in compliance with applicable laws and regulations. Fraudulent use, hacking, API credit abuse, or attempts to bypass platform security are strictly prohibited.

    Article 9 - Right of Withdrawal & Immediate Execution

    In accordance with regulations governing digital services and online dematerialized content, the Client expressly agrees that the SaaS service starts immediately after payment confirmation. Consequently, the Client waives their right of withdrawal to access the MyDataNest platform immediately.

    Article 10 - Customer Support & Claims

    For any questions, claims, or technical assistance, the Client can contact support at the following email address: info@mydatanest.app. The Provider will make reasonable efforts to respond promptly.

    Article 11 - Availability & Liability

    The Provider uses commercially reasonable efforts to maintain 24/7 service availability. The Provider is not liable for temporary maintenance downtime, internet outages, or unauthorized account misuse. Total liability is strictly limited to the annual amount paid by the Client.

    Article 12 - Force Majeure

    The liability of the Parties cannot be engaged if the execution or delay in the execution of one of their obligations stems from a force majeure event as defined by law (including major cyberattacks, natural disasters, or global network outages).

    Article 13 - Severability & Modifications

    If any clause of these T&Cs is declared void or unenforceable, the remaining clauses shall remain in full force. The Provider reserves the right to modify these terms at any time. The applicable terms are those active at the date of use or billing.

    Article 14 - Governing Law & Dispute Resolution

    These T&Cs are governed by Thai law. In the event of a dispute, the Parties agree to search for an amicable solution first. If no agreement is reached, the dispute will be submitted to the exclusive jurisdiction of the competent courts of Bangkok, Thailand.
